Photography contract MUST be filled out before session takes place.

This is a contract for personal photography services to be provided by

Peridot Rain Photography. 

You agree to the following terms and conditions.

PRICING:

If your session requires a sitting fee, it is due before or at the time of your session. If it is not paid your photos will not be edited until fee has been paid. In some cases the session may not be able to proceed at all until the sitting fee is paid.

Proofs will be uploaded to your own personal online gallery to view and/or purchase. Proofs are stamped with a copyright watermark. Removing watermark is illegal.

Deposits are not collected at this point of time except for weddings. This may change at any given time.

Sitting fee can be paid through Pay Pal at the end of this form or at the session.

All fees can be paid by cash, cheques, Paypal or e-transfers.

MODEL RELEASE:

I hereby grant to Peridot Rain Photography the absolute right and permission to copyright and use, re-use and publish photographic pictures of me or in which I may be included in for website display and/or internet social media, advertising, or any other legal purpose. Names of clients are not used. I also consent to the use of any printed matter in conjunction therewith. I hereby waive any right that I may have to inspect or approve the finished product or the advertising copy or printed matter that may be used in connection therewith or the use to which it may be applied.

I acknowledge that I am at least 18 years old, and have the right and ability to consent to the terms herein, and further, that I am authorized and able to sign on behalf of all persons under the age of 18.

I have read, and understood, and agree to the terms of this model release.

CREATIVE LICENSE: Images are edited at the photographers discretion, and delivered images will not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographers artistic standards. On average 20-25 edited images (or up to 10 images for mini sessions) chosen by the photographer are available to the client. Amount of photos vary depending on the type of session and any specials held may have a different amount of images available. 

Weddings include many more images, amounts depend on the package chosen.

SOLE PHOTOGRAPHER: Peridot Rain Photography is the sole photographer scheduled for the session. 

No other cameras or recording devices are to be used during the session. For weddings see wedding contract*

DIGITAL FILE STORAGE: The purchase of the images releases Peridot Rain Photography from any liability due to loss or damage of the images and also releases Peridot Rain Photography for any obligation to maintain copies of any digital file, image or photograph. The client is responsible for creating back ups of the digital content.

NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs without permission or purchasing the images either by digital downloads or on a CD. This includes scanning, downloading and printing any images from Peridot Rain Photography website or Facebook page. It is also illegal to alter photos in any way other than necessary print cropping for different print sizes on digital files purchased. Stolen photographs will result in the obligation to purchase the digital files stolen for a fee of $500 per image stolen.

Peridot Rain Photography retains the copyright to all images produced by Peridot Rain Photography. Only the digital images purchased will include written release to make personal copies. There will be No written release to make personal copies from photographic prints. License does not incude use that results in financial gain, including but not limited to: advertising, print sale profit stock photography, or resale of any nature. The client understands the images given on DVD or CD or via online download can not be altered in any way or be used for advertising or profit.

LIMITATION OF LIABILITY: Peridot Rain Photography takes the utmost care with respect to editing, exposure, development and delivery of portraits or CD’s. However due to any event or act outside the control of Peridot Rain Photography for loss damage or failure to deliver images for any reason Peridot Rain Photography limits any liability solely to the refund of the amount of monies paid on this agreement.

In the unlikely event of a total photographic failure, injury, illness, death in the family or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

DELIVERY: Images are edited and released to the customer on average of 10 days. Sneak Peaks are usually sooner. In the event of a heavier workload images can take up to 2 - 3 weeks to complete. 

Sessions that include images on CD or DVD include ONE disc. Additional discs may be purchased for a fee.

DIGITAL DOWNLOADS: Sessions that are delivered by digital download come with an online password protected gallery. Galleries are available on average of 2 weeks and then they will expire. If client requires for galleries to be uploaded and reopened a charge of $25.00 applies. It is illegal to copy or reproduce files without purchasing the download. Stolen photographs will result in the obligation to purchase the digital files stolen for a fee of $500 per image stolen.

PUNCTUALITY: The client and photographer agree that punctuality is important to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If client does not arrive at the appointed time shooting will still finish at the scheduled end time. Any additional shooting time beyond scheduled end time may be subject to additional changes. Unforseen weather or circumstances beyond ones control is forgiven within a reasonable amount of tardiness.

DISC OR DOWNLOAD:
